These Terms of Service (the "Terms") govern your access to and use of luxurybrandscollective.com (the "Site") and any purchase you make through it. The Site is owned and operated by Luxury Brands Collective LLC ("Luxury Brands Collective," "we," "us," or "our"). By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on this Site. By using the Site, you represent that you meet this requirement. Certain products sold on this Site are intended for use by licensed cosmetology professionals or individuals with equivalent training — see our Patch Test & Product Safety Disclaimer for details.

Wholesale and Trade Accounts

Some areas of the Site and certain pricing are available only to approved wholesale/trade accounts. Access to wholesale pricing is subject to application, review, and approval, and may be revoked at our discretion for misuse, including resale outside the terms of your trade account agreement.

Products, Pricing, and Availability

We attempt to describe and display our products, including pricing, as accurately as possible, but we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, current, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information, including after an order has been submitted, without prior notice. All prices are subject to change without notice. We reserve the right to limit quantities, refuse, or cancel any order at our discretion, including orders that appear to be placed by resellers outside an approved trade agreement, dealers, or distributors.

Orders and Payment

By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized or illegal activity, or errors in pricing or product information. Sales tax will be added where required by law.

Product Use and Safety

Certain products sold on this Site, including permanent hair color, developers, and lighteners, carry specific safety requirements, including a mandatory patch test before every use. Please review our Patch Test & Product Safety Disclaimer before using any such product. You are responsible for following all manufacturer instructions and warnings included with your order.

Intellectual Property

All content on this Site, including text, graphics, logos, images, and product names, is the property of Luxury Brands Collective or its licensors and is protected by applicable intellectual property laws. To the fullest extent permitted by law, Luxury Brands Collective and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or any product purchased through it. Our total liability for any claim arising from these Terms or your use of the Site will not exceed the amount you paid for the product(s) giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Luxury Brands Collective and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.
